Termini e condizioni del servizio

These Terms of Service govern the use of https://quorivella.shop (the "Site") and every contract of sale concluded through it between you and Quorivella ("we", "us", "our"). They apply to consumers within the meaning of Article 3 of the Italian Consumer Code (Codice del Consumo, Legislative Decree No. 206/2005). By placing an order, you accept these Terms together with our Return and Refund Policy, Shipping Policy, Privacy Policy, and Legal Notice.

1. Provider

  • Provider: Quorivella
  • Website: https://quorivella.shop
  • Email: hello@quorivella.shop
  • VAT identification: stated on every invoice and available on request

2. Scope and applicable law

These Terms apply to all orders placed through the Site. The contractual relationship is governed by the Italian Consumer Code (Codice del Consumo, Legislative Decree No. 206/2005) and the mandatory provisions of European Union consumer law. Mandatory consumer protection provisions apply in addition to these Terms and prevail over any conflicting clause. These Terms are written in English; the contract language is English.

3. Conclusion of the contract

The presentation of products on the Site is an invitation to place an order, not a binding offer. By clicking "Place order", you submit a binding offer to purchase the goods in your cart.

We accept your offer by sending an order confirmation email, or by dispatching the goods, whichever occurs first. If we cannot accept an order — for example because an item is out of stock, a price was displayed in error, or we suspect fraud — we will inform you without undue delay and refund any payment already made.

The contract text is stored by us and sent to you with the order confirmation. You can also review these Terms at any time on this page.

Before placing your order, the checkout page shows the essential details: the goods, the total price including VAT, the delivery costs (none for standard delivery), the delivery time, your right of withdrawal, and the minimum duration of the contract where relevant.

4. Prices, VAT, and shipping costs

All prices shown on the Site are total prices in the currency displayed at checkout and include statutory VAT at the rate applicable in Italy (currently 22%). Prices exclude delivery costs, which are shown separately before you place your order; standard delivery within Italy is free of charge.

We may change prices at any time, but the price displayed at the moment you place your order applies to that order. Obvious errors in pricing or product descriptions do not bind us where you could reasonably have recognised the error; in that case we will contact you before dispatch and you may confirm or cancel the order.

5. Payment

We accept the payment methods displayed at checkout. Payment is due at the time of ordering. Where payment is processed by a third-party provider, that provider's terms apply in addition to these Terms.

We reserve the right to exclude payment methods in individual cases, in particular where an order is flagged by our fraud-prevention checks.

6. Delivery

We deliver within Italy. Standard delivery is free of charge. Orders are processed within 1 to 3 business days and delivered within 15 to 20 business days of order confirmation; remote areas may take longer.

We deliver within 30 days of the conclusion of the contract at the latest, in accordance with Article 61 of the Italian Consumer Code (Codice del Consumo). If we fail to meet that deadline, you may set a reasonable additional period and, if we still do not deliver, withdraw from the contract and obtain a full refund.

Risk of loss or damage passes to you when you or a third party nominated by you take physical possession of the goods.

7. Right of withdrawal and returns

You have a statutory right of withdrawal of 14 days, described in detail in our Return and Refund Policy, together with our voluntary 30-day return promise. Information on how to exercise the right of withdrawal, on the return shipping costs you bear, and on the model withdrawal form is set out in that policy, which forms part of these Terms.

8. Conformity and guarantee

We are liable for defects in accordance with the statutory provisions described in our Return and Refund Policy. Nothing in these Terms shortens the statutory limitation period or limits your statutory remedies for defective goods.

9. Retention of title

The goods remain our property until the purchase price has been paid in full.

10. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, for the breach of essential contractual obligations, and where liability is mandatory by law. For the breach of essential contractual obligations caused by slight negligence, our liability is limited to the damage typical for this type of contract and foreseeable at the time of conclusion.

We are not liable for damage caused by misuse of the goods, failure to follow instructions, normal wear and tear, or modifications made by you or a third party.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the statutory guarantee of conformity and product liability.

11. Availability and changes to the Site

We aim to keep the Site available but cannot guarantee uninterrupted access. We may change, suspend, or discontinue parts of the Site, provided this does not affect orders already confirmed.

12. Your obligations

You agree to provide accurate and complete information when ordering, to use the Site lawfully, and not to interfere with its operation, scrape it at scale, attempt unauthorised access, or use it to infringe the rights of others. You are responsible for keeping your account credentials confidential.

13. Intellectual property

All content on the Site — text, product descriptions, photographs, graphics, logos, and page layouts — is protected by copyright and other intellectual property rights owned by us or our licensors. You may use the content for private, non-commercial purposes only. Reproduction, distribution, or commercial use requires our prior written consent.

14. Reviews and user content

If you submit a review, rating, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to publish, reproduce, and display that content in connection with our products. You confirm that the content is accurate, that you are entitled to publish it, and that it does not infringe third-party rights.

We moderate reviews only for unlawful content, personal data of third parties, spam, and content unrelated to the product. We do not remove a review merely because it is negative, and we do not publish reviews written by our staff as customer reviews.

15. Force majeure

We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural disasters, severe weather, strikes, carrier or infrastructure failures, official measures, and epidemics. If such an event lasts more than 30 days, either party may withdraw from the affected contract; payments already made will be refunded.

16. Governing law

These Terms and all contracts concluded through the Site are governed by Italian law, with the mandatory provisions of European Union consumer law applying in addition. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence, in particular the Italian Consumer Code.

For disputes with consumers, the competent court is the court of the consumer's place of residence or domicile (Article 66-bis of the Italian Consumer Code). That forum is mandatory and cannot be derogated from by agreement.

17. Dispute resolution and complaints

Before bringing a claim, please contact us at hello@quorivella.shop with a description of the issue and the outcome you are seeking. We will respond within 30 days, and most matters are resolved at this stage.

Consumers resident in Italy may use the alternative dispute resolution (ADR) bodies registered with the Autorità Garante della Concorrenza e del Mercato (AGCM) or contact the European Consumer Centre Italy (Centro Europeo Consumatori Italia) for assistance with cross-border disputes. The European Commission's Online Dispute Resolution platform has been discontinued.

Nothing in this section prevents you from bringing a claim before the competent court under Article 66-bis of the Italian Consumer Code.

18. Severability and no waiver

If any provision of these Terms is invalid, the remaining provisions remain in force and the invalid provision is replaced by the statutory rule. Our failure to enforce a provision is not a waiver of that provision.

19. Changes to these Terms

We may amend these Terms for future orders. The version in force at the time you place your order governs that contract. The current version is always available on this page with the date of the last update; material changes will be announced on the Site.
